Case note on UniCredit Bank GmbH v RusChemAlliance LLC

Andreas Giannakopoulos has written a case note on UniCredit Bank GmbH v RusChemAlliance LLC [2024] UKSC 30 which has recently been published in the Law Quarterly Review. The note examines the Supreme Court’s judgment in detail, including its indication that forum conveniens principles do not apply where a claimant seeks permission to serve a claim for an anti-suit injunction out of the jurisdiction in order to restrain breach of an arbitration agreement. It also considers the Supreme Court’s departure from obiter dicta in Enka Insaat Ve Sanayi AS v OOO Insurance Company Chubb [2020] UKSC 38 regarding the identification of the governing law of an arbitration agreement.
