WATCH: Demystifying funding in insolvency litigation: A practical guide

Join the panellists as they follow the life cycle of an insolvency claim and the duties an IP has to creditors throughout the process:

  • Geoff Carton-Kelly of FRP Advisory will begin by discussing his work as an IP conducting internal investigations, liaising with creditors regarding any potential actions that may have been identified before then going external to a law firm/counsel to assist.
  • Alex Jay of Stewarts will then talk about what information he requires from Geoff in order to evaluate a claim and how to bring it forward.
  • Finally, Charles Jeffery of Harbour will discuss what he requires from both Geoff and Alex in order to consider a claim for funding: costs, dealing with creditors and IP duties.
  • Marcia Shekerdemian QC of Wilberforce Chambers will chair the session.

The speakers:

  • Geoff Carton-Kelly (FRP Advisory) is a Partner and Licensed Insolvency Practitioner with more than 35 years’ experience, taking formal appointments since 1998. More recently his primary focus has been on contentious insolvency, international asset tracing and recovery projects, real estate, and charities. He advises boards and stakeholders, claimants, and government agencies on a range of recovery solutions including issuing proceedings against third parties in multiple jurisdictions.
  • Alex Jay (Stewarts) leads the contentious insolvency and asset recovery team at Stewarts, focusing on disputes arising from distressed and insolvent situations, often involving allegations of breach of duty, fraud and dishonesty. Alex focuses on maximising returns to his clients, and recovering substantial assets quickly and efficiently.
  • Charles Jeffery (Harbour) has been funding insolvency litigation in the UK, offshore and Asian jurisdictions for almost 8 years and has funded claims from $1m up to, and in excess of $1bn. He was also jointly responsible for implementing a claim assignment structure to the EMEA region.
  • Marcia Shekerdemian QC (Wilberforce Chambers) is a leading practitioner in all aspects of contentious and non-contentious insolvency, company and partnership law as well as commercial litigation. Her work encompasses both domestic and international matters. She also sits as a Deputy ICC Judge in the Business and Property Courts.
