Data Protection for Officeholders – The Essentials: Lexa Hilliard QC
The introduction of the Data Protection Act 2018 in May this year has caused nervousness against the backdrop of several, high profile, data breaches and fines. Lexa Hilliard QC has an in-depth knowledge of the area. In this session she will discuss some of the cases that she has been involved in and the steps IPs need to take when confronted with sensitive personal data and requests for transfer of data overseas.
9.00am: Talk 2
Privilege Issues in Insolvency and the Insolvency Practitioner – Practical Problems: Iain Pester
Issues of legal professional privilege continue to make news. In Shlosberg v Avonwick Holdings Ltd [2017] Ch 210 (CA), the Court of Appeal set out guidance on the interrelationship between the Insolvency Act and the privilege of a bankrupt. However, as shown by subsequent cases (e.g. Leeds v Lemos [2018] Ch 81, where Marcia Skekerdemian QC appeared for the wife of the bankrupt), the Court of Appeal’s decision leaves much unclear. In this session, Iain Pester will speak on the practical problems faced by trustees when meeting a claim from a bankrupt that information held is privileged, and will also consider the limits of the Court of Appeal’s decision in Shlosberg.
9.15am: Q&A
9.30am: Coffee and networking
Please note, this event is free of charge to attend. Spaces are limited and will be allocated on a first-come, first-served basis.
