WATCH: Leasehold Guarantees: Achieving the right result

We would like to invite you to join three Wilberforce Property practitioners in a session looking at practical issues that arise in relation to claims on leasehold guarantees. As we emerge from the Covid pandemic, renewed focus will fall on leasehold guarantees as a route to recovery for landlords. This is a technically complex area of the law with a combination of specific contractual and statutory principles interacting with one another. Now is the time to brush up on the law and consider how to make it work for your clients. This briefing aims to help you do just that.

Julian Greenhill QCEmer Murphy and Harriet Holmes will discuss relevant topics such as:

  • Guarantee vs indemnity: what’s the difference?
  • Discharge by variation: finding and opposing arguments
  • AGAs and GAGAs
  • Pre-conditions for liability: section 17 of the 1995 Act
  • Anti-avoidance under the 1995 Act: section 25 and recent cases on construction
  • “Old tenancies”: who to pursue
