Canary Wharf v European Medicines Agency
Judgment is out on the much-talked-about case of Canary Wharf v European Medicines Agency: the Agency’s London lease will not be frustrated by the UK’s departure from the EU or the Agency’s move to Amsterdam. On 1st March, EMA was granted permission to appeal by Marcus Smith J, subject to a condition that it continue to comply with its lease obligations pending any appeal but without prejudice to its argument that the lease will be frustrated by Brexit.
