James McCreath features in The Lawyer’s Top 10 Appeals of 2023

Following on from last month’s Top 20 cases of 2023 article, The Lawyer has published it’s Top 10 Appeals of 2023.

The Supreme Court case of The Manchester Ship Canal Company v United Utilities Water features on the list and James McCreath is acting for the respondent, United Utilities Water, with Falcon Chambers’ Jonathan Karas KC, and Landmark Chambers’ James Maurici KC and Richard Moules, instructed by Pinsent Masons partners Michael Smith and Matthew Baker.

The latest round of this long-running litigation concerns discharges of sewage into rivers and the sea in times of heavy rain. United Utilities has secured a declaration in the High Court and Court of Appeal that private landowners cannot bring claims in respect of those discharges on the basis that they are an invasion of their property rights. The case will be heard in the Supreme Court in March 2023.
