Jonathan Seitler QC is instructed in two appeals featured in The Lawyer’s “Top 10 Appeals of 2022” list. This follows the recent announcement of Jonathan’s presence in The Lawyers Hot 100 2022 list, and also the recent news that Wilberforce’s Ian Croxford QC and Bobby Friedman were separately involved in three of The Lawyer’s Top 20 Cases of 2022. Furthermore, John McGhee QC is instructed in two related Supreme Court appeals being heard together with On Tower UK v AP Wireless II UK.

Jonathan Seitler QC is appearing for the appellant, On Tower UK, and is instructed by Alicia Foo of Pinsent Masons.
Heard together at The Supreme Court with the above appeal are the appeals of Cornerstone v Ashloch and Cornerstone v Compton Beauchamp where John McGhee QC is acting for the appellant in both cases, Cornerstone, and is instructed by Martin Thomas of Gowling WLG.
These appeals mark a landmark as it is the first time The Supreme Court has considered the new Telecoms Code and it is the first Supreme Court ruling on who is an occupier for the purposes of the Telecoms Code; the legal issue which has side-tracked the industry since its coming into force.

Jonathan Seitler QC is appearing for the respondent (the tenants and guarantor) and is instructed by Robert Payne of CMS.
This important case considers whether tenants of commercial property whose premises were closed during the COVID-19 lockdowns in 2020 and 2021 have to pay rent for those periods or whether there is a total failure of basis or implied term in their leases which suspends the rental obligation during those periods.
